The Heritage Foundation has filed a lawsuit against President Biden’s COVID-19 vaccine tenure for private employers, saying it is a ‘gross abuse’ of government power and a violation of freedom personal, the conservative think tank said Monday.

The American Center for Law and Justice filed a lawsuit on behalf of the Heritage Foundation with the United States Court of Appeals for the DC Circuit which asserted that Biden’s vaccine mandate, enforced by the Occupational Safety and Health Administration (OSHA), represents a “gross abuse of power” and “clearly encroaches on the police power of states expressly reserved by the Tenth Amendment.”

The lawsuit says the mandate “also exceeds the authority of the federal government under the Commerce Clause” and would “unacceptably” compel citizens “to act as the government would like them to act.”

Incoming Heritage chairman Kevin Roberts, who takes office on Wednesday, said the trial was unusual for the think tank but necessary.

“Historically, the Heritage Foundation has not taken legal action,” Roberts said in a statement. “The fact that we do so now should make it clear to any observer that we view this mandate as a deadly threat to our individual freedom and the values ​​that make America great. , freedom and opportunity for all, and it will continue to do so under my leadership. “

“I hope this trial is unnecessary,” he continued. “I wish we had an administration in the White House that respects the Constitution and the rule of law. Kay C. James, the foundation’s past president, issued a statement calling the mandate “unacceptable overbreadth” by the Biden administration.

“Dr. Roberts and I, as well as the Board of Trustees, have unanimously agreed that the Heritage Foundation has a vital role to play in the courts to protect and ensure the freedom of all Americans to make medical decisions for themselves, ”James said.

The foundation’s lawsuit comes days after OSHA announced it was complying with a court order and suspending the execution of the warrant on large private companies.

OSHA initially gave private companies with more than 100 employees a Jan. 4 deadline to comply with the warrant and threatened thousands of dollars in fines for rebel companies.

After the Fifth Circuit Court of Appeals on Nov. 12 ruled to uphold a stay of the OSHA order, the Department of Justice (DOJ) vowed to “vigorously defend” the warrant.

“This decision is just the start of the process to revise this important OSHA standard,” a spokesperson told Fox News on Nov. 13. all pending cases for further consideration. ”

Meanwhile, the White House said earlier this month it would delay its vaccine mandate deadline for federal contractors from Dec.8 to Jan.4.
