Adil Dghoughi, 31, parked in the driveway of Terry Turner’s house just outside of San Antonio, probably because he was lost. Turner then shot Dghoughi down. Turner, 65, has been charged with first degree murder and his lawyers say they plan to defend their client using the Texas controversy defense law, which in some cases allows homeowners to use lethal force against people on their property.
Some say the law is often used as a cover for racism, and it has been criticized especially when it has been used to defend George Zimmerman, a neighborhood warden in Florida, where a defense law has also been enacted, in the 2012 murder of Trayvon Martin, 17.
Dghoughi, a Muslim from Morocco, had lived in the United States since 2013. His family believe he stopped in Turner’s driveway to look up his route on his phone because he was in an unfamiliar neighborhood.

Turner in court documents alleges that Dghoughi pointed a gun at him, but no weapon was found other than his own. Turner fired two shots through the driver’s side front door glass as Dghoughi came out of the driveway in reverse, hitting Dghoughi’s hand and head.
Turner then told a 911 operator that he had just “killed a guy”. He was guilty of murder on October 22, nearly two weeks after Dghoughi’s death. He was released less than two hours later, according to Caldwell County records.
A spokesperson for the Texas section of the Council on American-Islamic Relations, or CAIR, told the Guardian Dghoughi’s death is “an outright murder” and Turner “should have been arrested the same day he shot and killed Adil”.
“It is a shame for this country and for our legal system that it took almost 14 days, as well as calls to the Department of Justice, Texas Rangers and other agencies, before the police department failed. do his very minimal search, arrest and charge Terry Turner, ”he said.
Ground defense requires an owner to have a immediate need to use lethal force.
