Babbitt’s family plan to file a $ 10million wrongful death complaint against the officer who shot her as she tried to make her way through a broken window near where lawmakers were evacuated.
The agent has already been cleared of wrongdoing by the Department of Justice.
A lawyer acting for the Babbitt family, Terry Roberts, alleged that she was “ambushed” by the officer and that the officer did not issue a warning before shooting.
