Shane Wayne Michael pulled down his Covid face mask before spitting in his victim’s face and yelling “If I have it, you have it.” “
Michael, 42, was at the Vision 4 Less eyewear store in Iowa, United States on November 11 last year, reports the Iowa Capital Dispatch.
While there, he reportedly wore his face mask lowered slightly, leaving his nose exposed.
Another customer, Mark Dinning, asked Michael to properly secure his mask, which resulted in the couple exchanging words before leaving and heading to the parking lot.
That’s when the attack began, with the two falling to the ground and Michael punching him in the eyes of his victim, before he was bitten back.
During the attack, Michael kneed the man in the groin several times before lowering his mask and spitting on him, as well as coughing on him.
Michael, however, reportedly claimed that the other man started the fight after he “examined his shoulder” and stung his stomach as he left the store.
A witness, Bob Darr, told officers Michael appeared to be the aggressor, following his victim outside and then launching the attack.
A member of the store’s staff also said Michael was the assailant, police said.
He was subsequently arrested and charged and, following a trial, he was reportedly convicted of intentional bodily harm causing serious bodily harm, carrying a mandatory 10-year prison sentence.
He was sentenced to 10 years in prison for the attack on Wednesday as his lawyer requested a new trial due to video evidence that was previously unavailable.
Michael’s father, Dennis Michael, reportedly said his son believed he was acting in self-defense and had not committed any crime.
He said his son has asthma, “so he’s not going to cover his nose and mouth because he can’t breathe. And there was no mask warrant in place. It was just a request from Vision 4 Less that people wear a mask, and he was. “
He claimed the sentence was not fair and added, “It’s like (Mr Dinning) got a black eye in a bar fight, and now my son faces 10 years in prison. “
