The Day in New London reports that the lawsuit filed by the Mohegan Tribal Gaming Authority on Friday is similar to the one that the Mashantucket Pequot Tribe, owner of Foxwoods Resort Casino, brought against the same insurer in February.
Insurer Factory Mutual Insurance Co., based in Johnston, Rhode Island, said in a court filing in the Mashantucket case that losses caused by viruses and contamination are specifically excluded from casino policy.
Factory Mutual is seeking to have the Mashantucket tribe lawsuit dismissed. A hearing in this case is scheduled for August 2. A message requesting comment on the Mohegan Tribal Gaming Authority lawsuit has been left at Factory Mutual.
The Mashantuckets claim in their lawsuit that more than $ 76 million in losses caused by pandemic-related closures at Foxwoods and other properties they own, including a spa, museum and golf course, should be covered by its “all risks” policy with Factory Mutual.
Mohegan’s authority, in his lawsuit, claimed his losses from the pandemic amounted to millions of dollars.
