But Keisel claimed Westbrook misheard him… and interpreted his words not only as a homophobic slur, but also as “racial.”
Westbrook said he thought he heard, “Get down on your knees like before. “
The ringleader then went nuclear on Keisel and his girlfriend, Jennifer Huff – and everything was filmed.
“I’m going to fuck you,” Westbrook said. “You and your wife. I will fuck you. “
Keisel said he was not only banned from Utah Jazz games for life, but was also fired from his job, kicked out of a pilot training program and received death threats.
Keisel et Huff continued Westbrook and the Jazz for $ 100 MILLION for libel, among other things, claiming that he was wrongly portrayed as a racist homophobe.
The judge explained that “whether a person is racist or a statement is racial is a matter of opinion which cannot be verified as true or false.”
The judge added:
The court also noted that Westbrook’s in-game threats were “crass and offensive” … but were not extreme and / or outrageous enough to recover damages.
The judge also said that Keisel and Huff stayed in the arena to watch the rest of the game and that there was never any real risk of Westbrook carrying out his threats.
Long story short, Keisel (although he can still appeal the decision) won’t get anything from Jazz or Westbrook…
