Harvey Weinstein was secretly charged with rape by a grand jury in Los Angeles, according to a report.

The indictment came “a few weeks ago” and closely resembles a criminal complaint filed in January 2020 by former DA Jackie Lacey, Fox News reported.

This will likely facilitate the extradition of the disgraced movie mogul from New York, where he is already serving a 23-year sentence for rape and sexual assault.

Weinstein faces 11 charges in California, including rape and sexual assault involving five incidents between 2004 and 2013.

If convicted, the former Hollywood producer faces up to 140 years in prison.

Fox reported that the sealed indictment, along with the arrest warrant for Weinstein, is expected to be released Monday afternoon following an extradition hearing in Erie, New York.

The Los Angeles prosecutor’s office did not respond to Fox’s inquiries regarding the indictment.

A lawyer for two of Weinstein’s five accusers in the Los Angeles case declined to comment.

The Los Angeles case against Weinstein, 69, has been delayed by the coronavirus pandemic, but the prosecutor’s office would not have wanted to wait any longer to continue.

Weinstein is currently serving his sentence at the Wende Correctional Center near Buffalo, a maximum security prison. Thanks to his lawyer, denied all the charges against him.

“These are outdated, unsubstantiated, unsubstantiated and non-credible allegations that arose during the hysteria of the #MeToo movement and we are confident that Mr. Weinstein will be acquitted as there is no credible evidence against him. He’s innocent, ”defense attorney Mark Werksman said.

At Monday’s hearing, Weinstein’s lawyers are expected to request a postponement of the extradition because his allegedly poor health could put him at risk due to the pandemic.

If the expected request is denied, Weinstein could be extradited to Los Angeles within 30 days.

Experts said an indictment can help Los Angeles prosecutors streamline court proceedings by going straight to trial.

If the extradition had been made solely on the basis of a criminal complaint, a preliminary hearing would have been necessary.

“It seems to me that Mr. Weinstein does not wish to be sent back to Los Angeles to face charges, but a delay in justice is justice denied,” said the prominent women’s rights lawyer.

Allred represents Mimi Haleyi, one of the women Weinstein was convicted of during his trial in New York City over a year ago.

In the Los Angeles case, she is defending an anonymous woman as well as model and actress Lauren Young, who appeared as a witness in Weinstein’s New York criminal trial.

Young said Weinstein sexually assaulted her in a Beverly Hills hotel room in February 2013.

She said she was stuck in a bathroom with the producer groping her while masturbating.

The other three women involved in the Los Angeles case were also reportedly assaulted in Beverly Hills hotels.

Regardless of the outcome of the Los Angeles case, Weinstein is expected to return to New York to serve the remainder of his 23-year sentence.

Earlier this month, Weinstein appealed his conviction for rape and sex crimes, saying he did not have a fair trial and that the incidents were “unmistakably consensual” and that many women who have testified at his trial just thought he was. ‘detestable’.

His attorneys filed a 166-page appeal in Manhattan on April 5, in which they claimed the judge allowed too much testimony about Weinstein’s reputation and character.

Weinstein was convicted of one count of criminal sexual assault in the first degree and one count of third degree rape last February. He was cleared of three other charges. He was sentenced on March 11.

“Put simply, the prosecution judged Weinstein’s character, not his conduct,” his lawyers said in their appeal Monday.

“With a year behind us and the emotions have calmed down, the transcript of the case confirms what we have always believed: that Mr. Weinstein was not given a fair trial… We have the utmost confidence that the the appeal division will correct those errors and send this the case back to a different judge, ”they said.

They say the jury ignored the facts of the case, instead focusing on the created public figure of Weinstein, and that the incidents themselves were “unmistakably” consensual.
