Police courts overturned a fine of € 135 imposed on a man while traveling for a work meeting after curfew hours.
The man had a valid reason for leaving the house under the curfew rules, but he did not have a travel exemption form with him as he was supposed to.

The 29-year-old man, from Bayonne, in southwestern France, was arrested by the police in December 2020 when he had just parked his car.

Even though he did not have a travel exemption form, he showed officers his work schedule which showed he had a meeting after the curfew, which at the time began at 6 p.m.

The police have always fined the man € 135.

Fine overturned by courts

But a Bayonne court ruled that since the man had a legitimate reason for being on the outside even without a waiver form, the fine should be overturned.

Lawyer Sébastien Binet said: “What should be prohibited is going out without a legitimate reason, not whether or not people have travel exemption forms.

“Individuals can use all the means at their disposal to justify the legitimacy of their reason for being outside. ”

What are the valid reasons for being outside after curfew?

Curfew rules are currently in place from 7:00 p.m. to 6:00 a.m. seven days a week across France.

Existing curfew rules will not change when new rules to stop the spread of the virus are introduced in France from Saturday April 3.

Valid reasons for being outside your home after curfew include:

  • Go to work, school or training
    You are allowed to travel between your home and your place of work or study if this is unavoidable
  • Medical appointments
    You can go for check-ups, exams, preventive procedures, treatments that cannot be practiced virtually and buy health products
  • Urgent family reasons
    This includes caring for vulnerable people and children
  • Administrative or judicial summons
    You can also go to appointments with a legal professional that cannot be done remotely.
  • Meeting with the administrative authorities
    At the request of an administrative authority, you can attend the appointments
  • Being disabled or accompanying a disabled person
    People with disabilities and their caregivers have an additional allowance to leave home
  • Transit for long distance travel
    This includes return from the airport, train station or bus station, travel between transit centers during a trip
  • Take an animal outside
    Short trips within a radius of 1 km from the house are permitted
