Britney Spears’ attorney has officially asked Jodi Montgomery to replace Jamie Spears as singer’s curator.
In court documents filed Tuesday and obtained by VarietyBritney Spears ‘attorney, Samuel Ingham, has requested Jamie Spears’ resignation from the role.
“The petitioner has called for the resignation of the current personal conservative, James P. Spears, who has temporarily relinquished his powers as of September 9, 2019,” the file read. “The contained petition calls for her replacement by Jodi Pais Montgomery, who has acted as her temporary curator since that date.
The petition also notes that Britney Spears “expressly reserves the right to request the termination of this guardianship.”
Jamie Spears temporarily resigned her post as Personal Curator for health reasons in September 2019 and has yet to return to the role. Jamie Spears remains co-curator of her estate with Bessemer Trust Company, which was appointed co-curator in November 2020.
If the request is granted, Montgomery would assume permanent guardianship of Britney Spears, which would give Montgomery control over the singer’s medical treatment. This role would also allow Montgomery to “restrict and limit visitors by all means”, pursue restraining orders if necessary, and appoint security guards and other guards.
In the filing, Ingham cites a 2014 order that states Britney Spears is unable “to consent to any form of medical treatment” as one of the reasons Montgomery should take over as permanent curator.
Ingham first filed a request to remove Jamie Spears from trusteeship in August 2020. Jamie Spears has been the singer’s curator since 2008.
The filing follows the documentary “Framing Britney Spears,” which rekindled public interest in Britney Spears guardianship, with many fans and public figures calling for #FreeBritney.
Britney Spears’ next guardianship hearing will be on April 27.
