ORLANDO, FLA. – Florida authorities say a Burger King employee was fatally shot after an argument over a delay in an order for food. The Orange County Sheriff’s Office identified the gunman in a press release on Sunday as Kelvis Rodriguez Tormes, 37. Authorities said he was charged with first degree murder with a firearm, destruction of evidence and possession of a firearm by a convicted felon.

The victim was identified as Desmond Armond Joshua Jr., 22, who had recently started working at the restaurant.

The Orlando Sentinel reported that Saturday night’s shooting followed a confrontation between Joshua and a woman during the time it took for a drive-through food order to be completed.

The woman was reimbursed, then left and returned with Rodriguez Tormes, authorities said. After a brawl, MPs claim Joshua was shot in the parking lot and later died in a hospital.

As of Sunday, prison records did not mention a lawyer for Rodriguez Tormes.
