The Connecticut Interscholastic Athletic Conference (CIAC) official manual says that the conference “must rely on the determination of the student and their local school regarding gender identification”, with no conditions relating to physical transitions or at testosterone levels, on the grounds that it “would be fundamentally unfair” to “prevent a student from participating in a gender-specific sports team that is consistent with that student’s public gender identity for any other purpose. “
Thanks to the CIAC policy, biologically male competitors have consistently outperformed real women, according to a complaint filed by Alliance Defending Freedom (ADF) on behalf of runners Selina Soule, Alana Smith and Chelsea Mitchell. In turn, this deprives girls not only of the opportunity to progress in competition, but also of the recognition that has an impact on their academic future through the loss of consideration for university recruitment and scholarship possibilities.
District judge Robert Chatigny last month ordered lawyers for ADF not to label the transgender contestants girls – who are in fact men – “male.” National review reported.
Chatigny asserted that the terminology “transgender women” was “consistent with science, common practice and perhaps human decency” without conceding “the legitimate interest or position of ADF” and that “men” were “Unnecessarily provocative”.
“This is not a case involving men who have decided to participate in the women’s events,” said the judge. “This is a case of girls who say that transgender girls should not be allowed to participate in women’s events. So, in the future, we will not qualify the proposed speakers as “males”; including? “
“The central point of the case is the fact that the CIAC policy allows physiologically and genetically male individuals to participate in female sporting competitions,” replied ADF chief counsel Roger Brooks, noting that the ADF was already “happy to use his favorite names,” but the fact remains that “the interest of this case is the physiology of the bodies moved by the chromosomes and the documented athletic advantage which comes from a male body, male hormones and male puberty in particular ”.
“So if you firmly believe that you and your customers have the right to designate these people as” men “and therefore do not want to comply with my order, then that is unfortunate,” replied Chatigny. “But I’ll give you some time to think about it and you can let me know if it’s a problem. If that’s the case, my God, we may have to do something. I don’t want to intimidate you, but at the same time, I don’t want you to intimidate someone else. You may have to go to the Court of Appeal. I do not know. But I certainly do not want to endanger civility in this case. “
On Saturday, the ADF filed a request asking Chatigny to recuse himself.
“A disinterested observer could reasonably believe that the court’s order and observations have destroyed the appearance of impartiality in these proceedings. This requires a challenge, “argues the motion. “Certainly, the public debate on gender identity and sports is passionate and emotional. This only increases the urgency for the courts to maintain their role as a unique place in society where all can be heard and present facts before an impartial tribunal. “
It is scandalous that the judge insisted that the lawyers for the plaintiffs contesting the men in the girls’ races call the men for the women.
Kind of like a judge in an abortion case who insists that those who advocate a restriction on abortion refer to the unborn as a drop of tissue. https://t.co/czzHuA3v82

Men who identify as women do not become women, despite what this judge and “science” may say. But the power to define reality is real and the judge is trying to exercise it. The lawyers of @AllianceDefends are right to exercise it also https://t.co/HMghPzSaGL

LGBT activist groups such as the National Center for Transgender Equality (NCTE) attacked the lawsuit as a “desperate attempt” to “strip transgender students of the rights each student deserves and of policies that offer them the same opportunities as all other students ”. But science supports the concerns of the complainants.
Last June, the Journal of Medical Ethics published an article by researchers in New Zealand finding that “healthy young men do not lose significant muscle mass (or potency) when their circulating testosterone level has been reduced to (below committee guidelines) International Olympic) for 20 weeks “and” indirect effects of testosterone “on factors such as bone structure, lung volume and heart size” will not be changed by hormone therapy “; therefore, “the benefit to transgender women (men) of the guidelines (of the International Olympic Committee) is an intolerable injustice.”
LifeSiteNews is currently launching a petition in support of the ADF complaint, which has so far collected more than 186,000 signatures.
